2.1 You are permitted to use our website for your own purposes and to print and download material from this Website provided that you do not modify any content without our consent. Material on this website must not be republished online or offline without our permission.
2.2 The copyright and other intellectual property rights in all material on this Website are owned by us or our licensors and must not be reproduced without our prior consent.
2.3 Subject to paragraph 2.1, no part of this Website may be reproduced without our prior written permission.
3. Site uptime
3.1 We take all reasonable steps to ensure that this Website is available 24 hours every day, 365 days per year. However, websites do sometimes encounter downtime due to server and, other technical issues. Therefore we will not be liable if this website is unavailable at any time.
3.2 This Website may be temporarily unavailable due to issues such as system failure, maintenance or repair or for reasons beyond our control. Where possible we will try to give our visitors advance warning of maintenance issues but shall not be obliged to do so.
4. Visitor conduct
4.2 When using this website you shall not post or send to or from this Website any material:
(a) for which you have not obtained all necessary consents;
(b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom;
(c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

7. Exclusion of liability
7.1 Neither we nor any other party (whether or not involved in producing, maintaining or delivering this Website), shall be liability or responsible for any kind of loss or damage that may result to you or a third party as a result of your or their use of our website. This exclusion shall include servicing or repair costs and, without limitation, any other direct, indirect or consequential loss, and whether in tort or contract or otherwise in connection with this Website.
7.2 Nothing in these Terms shall exclude or limit liability for (i) death or personal injury caused by negligence (as defined by the Unfair Contract Terms Act 1977); (ii) fraud; (iii) misrepresentation as to a fundamental matter; or (iv) any liability which cannot be excluded or limited under the law of the United Kingdom.
8. Governing Jurisdiction
This Legal Notice shall be governed by and construed in accordance with English law. Any dispute(s) arising in connection with this Legal Notice are subject to the exclusive jurisdiction of England and Wales.
We use our reasonable endeavours to make sure that every product on our website is shown accurately and that prices are correct. However, occasionally there may be small variations in colour, typefaces and layout.
Placing an order
When you place an order with us (by choosing your item(s) and completing our online checkout process), we will send you an acknowledgement by email. This will detail the products you have ordered. Please note that your completion of the online checkout process does not constitute our acceptance of your order.
From time to time, we may not be able to accept an order for the following reasons:
• If, unfortunately, your chosen goods are not available
• Where we cannot obtain authorisation for your payment
• If there has been a pricing or product description error
• If you do not meet any eligibility criteria set out in our terms and conditions
• If your order for personalised products* contains content which is threatening, defamatory, obscene, indecent, seditious, offensive, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience
We reserve the right to cancel your order at any time and issue a full refund. This does not affect your statutory rights.
*Please double check all spelling as we are not liable if you have misspelled any names or text. Please note, a refund will not be issued.
You can pay for your goods using your Paypal account or credit/debit cards via Paypal. You do not have to have a Paypal account to do this.
All orders are free delivery .All deliveries are usually made from 8AM to 8PM
If any of the details you have given us in your delivery address are incorrect, we are not liable for any items which are not received.
We can deliver your order any day from Tuesday to Friday (inclusive) to most UK mainland addresses.
Please call to confirm before placing your order, if you live in a remote area, Scotland or the highlands or have any special requirements. Additional Postage and packing charges may apply.
All of our products are sent to you freshly baked and securely packaged. We also use coolants.
Your order will be delivered by 8pm at the latest on the date specified in your confirmation email (normally within 3 working days of placing your order if directly dispatched from ourselves, if third party dispatch deliveries can take 5-7 working days). Plan ahead if your order is for a special occasion, as all of our products have a minimum 6-day shelf life from when they reach you (unless otherwise specified on actual product or on the FAQ).
Your order can be tracked by calling our office and a member of staff will give you the tracking order number.
We do not accept responsibility for any courier issues.
Be sure that there is someone is at the address when your order is delivered as it will need to be signed for. Failure to accept delivery will result in you still being charged, no refund will be offered
Contact Number When placing your order you will be required to put a contact telephone number (preferably a mobile) which will be used by the delivery company to enable the driver to contact you prior to delivery. Please specify:
•If you live in a block of flats
•The products are being delivered to a business address or venue
•Or your order is to be left in a safe place or with a neighbour
Please add any relevant information when placing your order (special request box).
Unpack your order immediately and refrigerate at 4-5 degrees. Do not leave your products in direct sunlight or a warm room. Take out of the packaging and dispose of coolants.
Please note that deliveries can be affected by public or Bank Holidays.
If an order date is requested, we will try our upmost to fulfil the order for the date required. However we cannot guarantee this order date ( we will notify you if this has to be changed )
Cut off dates for Christmas 2020 – orders placed before 13th December will dispatched from the 17th December 2020. Any orders placed after this date will be delivered on the 30th December
Cut off dates for New Year 2020 – orders placed from the 14th December – 18th December will be delivered on the 30th December
Any orders placed after the 18th December will be delivered in the New Year
Circumstances beyond our control
Neither we, nor the courier service shall be liable for any failure to perform, where such failure or delay results from any circumstances outside our reasonable control; these circumstances to include but not be limited to any adverse weather conditions – such as snow, flood, extreme winds, fire, explosion, accident, traffic congestion, obstruction of any private or public highway, riot, terrorism, act of God, or from any industrial dispute or strike.
Changing or cancelling an order
All products are handmade to order. Therefore, you must call or email us prior to production (normally within 24 hours of placing your order) if you need to change or cancel it.
Telephone calls and emails are answered during business hours (8.30am – 5.00pm Monday to Thursday and 8.30am – 4.30pm on Friday) in the order they are received. It is therefore possible that your order could begin production before your email is processed and we will be unable to make any changes. We will confirm any order amendment or cancellation via email.
You will not be able to change or cancel your order once production has begun. No refunds will be given.
In the unfortunate event that that your order arrives damaged, please call or email us immediately. Do not remove the product from its original packaging as you will be required to send us photographic evidence. A replacement will normally be dispatched within 48 hours.
The Topping Pie Company’s decision regarding order amendments, cancellations and refunds is final.
Your privacy is important to us. It is Toppings Pies’ policy to respect your privacy regarding any information we may collect from you across our website, https://www.toppingspies.co.uk, and other sites we own and operate.
We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.
We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorised access, disclosure, copying, use or modification.
We don’t share any personally identifying information publicly or with third-parties, except when required to by law.
Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.
You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.
